Will of William Moore Adey

of Wotton under Edge, Gloucestershire attested 13 Jun 1832

This is the last Will and Testament of me William Moore Adey of Wotton Underedge in the County of Gloucester Esquire I direct my just debts funeral and testamentary expences to be in the first place paid and satisfied by my Executrix and Executors hereinafter named I give and bequeath to my Wife Emma Adey all the dividends due to me on money invested in the ffunds and also all Interest due to me and in the hands of my Bankers and also all the money in and about my Dwellinghouse at the time of my decease for her own benefit and disposal I also give and bequeath all and singular my household goods and furniture plate linen china books prints pictures jewels trinkets ornaments of the person and all other my household effects of every description and kind whatsoever unto my said Wife Emma Adey for and during the term of her natural life And from and immediately after her death I give and bequeath the same household goods furniture and other last mentioned effects unto and equally between my Sons William Moore Adey and Anthony Adey and their respective executors administrators and assigns for ever as Tenants in Common Nevertheless it is my Will and I hereby direct that my said Wife may at any time during her lifetime dispose of or give any part of my household goods furniture plate linen china and other effects unto my said Sons but in such manner only as that any disposition or gift which may be made in favor of one of them may not be to the prejudice of the other it being my Will and desire that each Son may receive his due and fair proportion of the same household goods furniture plate linen china and other effects either in taking an equal share or receiving some equivalent or value I give and devise unto my said Wife All that Close of Meadow or Pasture Ground called Toad Pool Leaze containing by admeasurement Two Acres one rood and Nineteen Perches (more or less) And also all that my other Close of Meadow being an Orchard and planted with ffruit called Toad Pool Leaze containing by admeasurement half an Acre adjoining to each other And also All that Close of Meadow or Pasture Ground called the Picked Leaze containing by admeasurement One Acre and twelve perches which said Closes Pieces or Parcels of Land are situate in the Parish of Wotton Underedge aforesaid and now in my own possession and purchased by me of and from Colonel Berkeley To hold to her my said Wife for and during the term of her natural life And from and immediately after her decease I give and devise the same several Closes of Land and Hereditaments unto my Son the said William Moore Adey his heirs and assigns for ever(Subject nevertheless to and charged and chargeable with the payment at the expiration of twelve Months after the death of my said Wife to my said Son Anthony Adey of such a sum of money as may by two persons one to be chosen by my said Son William Moore Adey and the other by my said Son Anthony and in case of difference of opinion by a third person to be appointed by an Umpire by the Referees be considered to be the half value of the said Closes of Land and Hereditaments I give and devise unto my Son the said William Moore Adey All that Close Piece or Parcel of Pasture or Orchard Ground with the Appurtenances thereto belonging containing by estimation half an Acre (more or less) And also all that other Close Piece or Parcel of Pasture or Orchard Ground together with the Appurtenances thereto belonging containing by estimation half an Acre (more or less) And which said two Closes Pieces or Parcels of Pasture or Orchard Ground are situate lying and being in the Parish of Wotton Underedge aforesaid in the occupation of Edward Watts and were heretofore purchased by my late father Charles Adey Esqr of and from Mrs Mary Moulton And also all that Piece or Parcel of Pasture Ground with the Appurtenances thereto belonging situate lying and being at Combe in the Parish of Wotton Underedge aforesaid containing by estimation three Roods and twenty four perches (more or less) and now in the occupation of the said Edward Watts And also all that Stove or Outhouse standing and being in the Corner of the last mentioned Piece of Ground and now in the occupation of Robert Neal as Tenant thereof together with the rights members and appurtenances thereunto belonging To hold the said the same several Closes Pieces or Parcels of Ground Orchard Dyehouse and hereditaments (subject nevertheless to such estates or interests as may be subsisting therein at the time of my decease) to him the said William Moore Adey his heirs and assigns for ever for and during all such estate or estates interest or interests as I shall have therein at the time of my decease I give and bequeath the principal sum of ffive hundred pounds now due and owing from one Mr Boorne and secured by Mortgage and also the principal sum of ffive hundred pounds now in the hands of Mr Andice of Bridgwater in the County of Somerset Gentleman the sum of One hundred pounds owing to me and secured by Mortgage upon the Wotton Underedge Turnpike Tolls and also one third part or share of the principal sum of Two thousand three hundred and fifty pounds stock in the Three Per Cent Reduced Annuities sold out and advanced by me and my Sisters to Robert Hale Blagden Hale Esq and which he hath agreed to replace together with such Interest as may become due thereon after my decease and also the principal sum of One thousand pounds which will be payable to me on the death of Timothy Larton of the City of Worcester Esquire unto and equally between my Sons the said William Moore Adey and Anthony Adey and their respective executors administrators and assigns for ever as Tenants in Common and not as Joint Tenants And as on the Marriage of my Daughter Helen with John Burland Harris Esquire I have made a Settlement or Provision and for her equal or exceeding the Amount the share or shares to which the said William Moore Adey and Anthony Adey her brothers will take under and by virtue of this my Will or otherwise I do therefore omit making any further provision for her but by way of remembrance I direct to be paid to my said Daughter Helen at the expiration of Twelve Calendar Months next after my decease the sum of fifty pounds which I desire may be expended in such manner for the use of my Granddaughter Jane Burland Harris as my said Daughter Helen shall think fit I give to my Servant Mary Reade the sum of Nineteen Guineas to be paid her at the expiration of Six Calendar Months after my decease in addition to any Wages which may be due and owing to her from me And all the Rest residue and Remainder of my Personal Estate and Effects whatsoever and wheresoever and of what nature or kind soever not hereinbefore specifically bequeathed and over which I have a disposing power I give and bequeath the same to my said Sons the said William Moore Adey and Anthony Adey and their respective executors administrators and assigns for ever as Tenants in Common and not as Joint Tenants And I do hereby give devise and bequeath unto my Wife the said Emma Adey The Reverend Thomas Cox of Alveston in the County of Warwick Clerk and John Dyer of Wotton Underedge aforesaid Gentleman according to the nature or quality or the respective natures or qualities of my respective estate and interest or respective estates and interest s therein respectively All and singular my ffreehold and Leasehold Hereditaments and premises with the appurtenances of or to which I am seized possessed or entitled as a Mortgagee for my own benefit or for the benefit of any person or persons as a Trustee for any purpose or purposes whatsoever to have and to hold the same freehold & leasehold hereditaments and every part thereof with the appurtenances and to the use of my said Trustees or the survivor of them their or his heirs executors administrators and assigns according to the nature or quality or respective natures or qualities of my estate or interest or respective estates or interests therein respectively Upon the trusts and for the purposes and subject to the equities of Redemption which at the time of my decease shall be subsisting or capable of taking effect herein and so far as it is in my power and I am entitled so to do And I do hereby direct that all conveyances assignments and assurances which shall be executed by my said Trustees or the survivor of them their or his heirs executors and administrators shall be good valid and effectual to all interests and purposes as if the same had been executed b y myself personally Provided always And I do hereby declare that the said several Executors and Trustees hereby appointed and each and every of them and the heirs executors administrators and assigns of each and every of them shall be charged and chargeable respectively for such monies only as they shall actually receive notwithstanding their and any of their giving or signing or joining giving or signing any receipt or receipts for the sake of conformity And any one or more of them shall not be answerable or accountable for the others or other of them or for involuntary losses And also that it shall and may be lawful for them with and out of the monies which shall come to their respective hands to retain to and reimburse themselves respectively and also to allow their respective Co-trustees or Co trustee all costs charges damages and expences which they or any or either of them shall or may suffer sustain expend disburse be at or be put unto in or about the execution of the aforesaid trusts or in relation thereunto And lastly I do hereby appoint the said Emma Adey Thomas Cox and John Dyer Executrix and Executors of this my Will hereby revoking all former and other Wills by me at any time heretofore made In Witness whereof I have to this my Will contained in ffour Sheets of Paper set my hand and Seal (that is to say) my hand at the bottom of the three preceding sheets and my hand and
