Eli Wainwright
THIS IS THE LAST WILL AND TESTAMENT of me ELI WAINWRIGHT of Newland Cogges near Witney in the County of Oxford Gentleman I revoke all former Wills and Testamentary Dispositions at any time heretofore made by me and I APPOINT my son John Wainwright of Charlbury in the said County of Oxford Miller Edward Hyde of Witney Surgeon and James Francis Marriott of Church Green Witney aforesaid Gentleman to be the Executors and Trustees of this my Will I give to each of them the said Edward Hyde and James Francis Marriott who shall act in the execution of the Trusts of this my Will the sum of five guineas free of legacy duty I GIVE DEVISE and BEQUEATH unto my daughter Anna Hicks the Wife of Charles Hicks of Northleigh in the said County of Oxford my two cottages with their appurtenances at Northleigh aforesaid in the occupation of Mrs Willett and Mrs Panting respectively my House and premises at Hailey in the said County now in the occupation of John Towersey Green and all my furniture plate linen china glass books pictures ornaments and other household effects and the sum of Three hundred pounds absolutely for her own use and benefit I GIVE DEVISE and BEQUEATH unto the said Charles Hicks my grass field called Stone Bridge Ground near Witney aforesaid and also the sum of Two hundred pounds I GIVE to John Wainwright Hicks and Stanley Charles Eli Hicks (children of my said daughter Anna Hicks) and to Elsie Wainwright (the daughter of my said son John Wainwright) the sum of One hundred pounds each I GIVE AND BEQUEATH all the rest and residue of my personal estate and property (except leaseholds) but subject to the payment thereout by my Executors of my debts and funeral and testamentary expenses to my son the said John Wainwright for his own absolute use and benefit I GIVE DEVISE AND BEQUEATH all my real Estate and property (including any leasehold property of which I may die possessed) not hereinbefore otherwise disposed of unto and to the use of my Trustees UPON TRUST to pay the rents profits and annual income thereof to my said son John Wainwright for and during his life or to permit him to receive the same and upon and after his decease UPON TRUST to sell and convert into money the same and to stand possessed of the net proceeds of such sale and conversion upon the following trusts that is to say AS TO ONE MOIETY or half part thereof IN TRUST to pay the same unto Elsie Wainwright the daughter of my said son John Wainwright if and when she shall attain the age of twenty five years but in case the said Elsie Wainwright shall die without having attained the age of twenty five years then UPON TRUST to pay the said moiety of the said net proceeds to my said daughter Anna Hicks if she shall survive the said John Wainwright and Elsie Wainwright but if she shall not so survive them then UPON TRUST for such child or children of the said Anna Hicks as shall be living at the death of the survivor of them the said John Wainwright and Elsie Wainwright and shall then have attained or shall thereafter attain the age of twenty one years or being a daughter or daughters shall then have married or shall thereafter have married under that age in equal shares if more than one AND AS TO THE OTHER HALF PART or moiety of the said net proceeds of sale UPON TRUST to
pay the same unto and among such of the children of my said son John Wainwright by his second Wife as shall be living at the date of his decease and as shall then have attained or shall thereafter attain the age of twenty one years or being a daughter or daughters shall then have married or shall thereafter marry under that age in equal shares as tenants in common and if only one such child then the whole to that child but if there shall be no such child or children living at the decease of my said son who shall live to attain a vested interest in the said moiety then UPON TRUST for my said daughter Anna Hicks in case she shall survive my said son but in case she shall predecease my said son then UPON TRUST for such child or children of my said daughter Anna Hicks as shall be living at the decease of my said son John Wainwright and as shall then have attained or shall thereafter attain the age of twenty one years or being a daughter or daughters shall then have married or shall thereafter marry under that age such children if more than one to take in equal shares and if only one such child then the whole to that child AND I DECLARE and direct and my will is that my Trustees shall invest any monies liable to investment by them under the trusts or provisions of this my Will by placing the same on deposit in any Joint Stock Bank having its principal Office in the City of London to be approved by my Trustees and that they shall not invest the said monies otherwise AND LASTLY I request my Trustees to complete the distribution of my estate under this my Will as far as possible (and so far as the provisions of this my Will permit) within six calendar months from the date of my decease
